They proceeded to aggressively grab Plaintiff about his head and body and search his clothing and personal belongings but did not recover any contrabrand that would indicate he had committed a crime. The Defendants then grabbed Plaintiff and violently contorted his arms and wrists beind his back and applied excessively tightened metal handcuffs, causing signiifcant pain and discomfort. Plaintiff requsted that the handcuffs be loosened, but the Defendants ignored his pleas. Certain Defendants were present and observed the foregoing conduct but did not intervene in the unlawful stop and search.\n\nPlaintiff was transported in a police vehicle to the 77th NYPD Precinct where he was strip-searched, interrogated without being Mirandized, and subsequently detained in a dank and dirty cell before being transported to Central Booking. He continued to be detained until he was transported to Rikers Island Correctional Facility. His detention lasted over the course of approximately 15 months. Defendants, incluing Napolitano, had signed and forwarded the criminal court complaint to the DA's Office, in which they affirmed the truth of fabricated allegations against Plaintiff. Plaintiff immediately went to the ground and placed is hands behind his head. Defendant Officers proceeded to kick and punch plaintiff in the face and head fracturing his jaw in two places. Plaintiff was handcuffed and his face was thrown into the window of the police vehicle. Plaintiff spent hours inside the vehicle and was denied medical treatment. As a result of the defendant officers conduct plaintiff suffered injuries that resulted in three hours of surgery and a four day stay at Brookdale University Hospital.
