The Defendants thereafter handcuffed Plaintiff and placed him under arrest for criminal sale of a controlled substance and initiated criminal proceedings against him, despite the Defendants’ knowledge that they lacked reasonable grounds or probable cause for doing so. Defendants did not make a full statement of facts to the District Attorney, withheld exculpatory evidence, and acted with malice in initiating and continuing criminal proceedings against Plaintiff. Defendants were motivated in part by the NYPD's custom of targeting minority males to meet arrest quotas.\n\nPlaintiff was taken to the 25th Precinct for processing, thereafter to Manhattan Central Booking for arraignment, and then to Rikers Island. Plaintiff was incarcerated from December 13, 2014 until December 17, 2014, when he was released from custody. On August 5, 2015, Plaintiff was acquitted of all charges. Defendant officers found no drugs where plaintiff was and unhappy with plaintiff’s answer that to his knowledge there was no drugs in the apartment, defendant struck plaintiff in the head. Defendants illegally ransacked plaintiff’s apartment, opened doors and closets, entered rooms, opened drawers and other closet containers, overturned furniture and destroyed property. Defendants took the plaintiff into custody and placed him under arresting alleging untruthfully claiming that they found one marijuana cigarette in an ashtray next the plaintiff’s bed and two hundred dollars that belonged to the plaintiff. Plaintiff was brought to the precinct and placed in a dirty cell covered in urine for several hours, then he was subsequently moved to the Central Booking Unit and placed in a holding cell for approximately 11:00 a.m. the following day, May 26, 2011. After plaintiff’s arraignment, the judge released him on his recognizance.
