The officers then entered his car and searched it without a search warrant for the car or an arrest warrant for Plaintiff Brown. Plaintiff had also not committed this crime. Yet, the Police officers, including Candela, fabricated multiple locations in which the noise due to engine exhaust had occurred. The search, according to the officers, yielded evidence of the unreasonable noise and Officer Candela arrested Brown, placing him in tight handcuffs. Brown believes that Officer Robert Candela took these actions in retaliation against a prior civil lawsuit by Plaintiff Brown against him that ruled in favor of Brown and led to disciplinary action against Candela. Plaintiff Brown was transported to the precinct, strip searched, photographed, and fingerprinted. He was not arraigned and was not formally charged because the Bronx District Attorney felt there was insufficient evidence.
