The defendants proceeded to use excessive force on the plaintiffs by slamming the plaintiffs onto the hood of a car, pressing the plaintiffs against the bar, twisting the plaintiffs' arms, placing tight handcuffs on the plaintiffs, and searching the plaintiffs multiple times. Further, the defendants seized and converted diamond earrings from plaintiff Ariam Kershaw without her consent. The defendants also damaged plaintiff Kershaw's eyeglasses during the unlawful search. The defendants took the plaintiffs into custody where they continued to subject the plaintiffs to unlawful searches, assaults, and excessive force. While in the defendants' custody, the plaintiffs were verbally abused, held in confinement for an extended period of time, denied food and medical assistance, forced to use unsanitary toilets, and suffered physical injuries. At all relevant times, the defendants lacked any warrant, reasonable cause, or probable cause of the plaintiffs' criminal activity. \n\nThe defendants, including the City of New York and the New York City Police Department, proceeded to maliciously prosecute the plaintiffs for crimes which they lacked probable cause. At the time, defendant officer’s were in an unmarked police vehcile with license plate HMM 5438. The defendant officer’s came out of the car and approached plaintiff. Defendant officer didn’t say anything to plaintiff before they spun plaintiff around. When plaintiff asked the defendant officers what they were doing, one of the officers told him to “shut up” and that he was being searched and that if he kept talking or moving he would “go to jail”. When plaintiff continued to protest, he was told he would be “going to jail” if he didn’t shut up. \n\nOne of the defendant officer’s pushed plaintiff’s pants down below his waist and placed is hand inside plaintiff’s underwear. The officer ran his hand across plaintiff’s bare buttocks and then reached around and grabbed plaintiff’s penis and testicles. A crowd gathered around at this point and another defendant officer pulled plaintiff’s pants down almost to his knees. Plaintiff pulled his pants up and attempted to grab his cellphone in hopes of recording, but defendant officer’s grabbed the phone and threw it to the ground. A marked police car arrived at the scene and defendant officers returned to their vehcile and drove away.
