In fear that the Protester would step back and step on his already fractured toe, Plaintiff stepped back and lost balance. Defendant Cheng swung at Plaintiff in an attempt to knock his phone out of his hands but instead struck him in the face. Plaintiff blocked 2 other punches thrown by Defendant Cheng. as other defendant officers including Defendants Cheng and Rahman assulted Plaintiff by punching him as he was tackled to the ground. while on the ground Plaintiff was punch several more times. Plaintiff yelled “I suffer from Epilepsy and please do not hit me in the head”. The Defendant Officers ignored his pleas and dragged him to the ground. Plaintiff, while on the ground, tried to protect himself by covering his head but was unsuccessful as his head was slammed against the concrete multiple times. Defendant Cheng then placed his knee on Plaintiff’s neck while applying pressure on his head as Plaintiff’s head was pressed against the concrete. \n\nPlaintiff was handcuffed and transported to the 71st Precinct, and then transported to the 72nd Precinct where he was detained overnight. Plaintiff received medical attention concerning his Epilepsy but not for his injuries. Plaintiff was shackled to and from the hospital and was searched six times before being processed. PO Welch was angered by the suggestion and PO Welch, Sergeant Cheng, and PO Mirza slammed plaintiff into a table and handcuffed her in the store. Plaintiff repeatedly informed the POs that the handcuffs were too tight and causing pain, but the officers refused to loosen them. Plaintiff was eventually taken outside, where she was slammed on the POs RMP and repeatedly slammed her with the RMP door while attempting to place her in the vehicle. Plaintiff already had a brace on the leg that was being hit with the door and she requested the officers take her to receive medical attention but the officers took her to the 71st precinct instead. Plaintiff continued to complain of knee pain and an ambulance was called, she was then taken to the Kings County Medical Center while still in custody. Plaintiff was at the hospital for approximately ten hours and she even wetted herself after an unidentified female PO refused to allow plaintiff to use the restroom. Plaintiff was then forced to strip from the waist down in front of a male officer that stared at her private area for approximately three minutes before she was allowed to change clothes. After this ordeal, plaintiff was returned to the 71st precinct where she received a desk appearance ticket. PO Welch attempted to have plaintiff placed back into a cell despite this not be the proper procedure after a person receives at desk appearance ticket. Plaintiff refused and was eventually released after being in custody for a little over fourteen hours.
