Plaintiffs were not engaged in any unlawful or suspicious activity at the time of the officers' arrival. The Plaintiffs were searched again at the precinct. Neither search yielded any evidence of guns, drugs, or contraband. While Plaintiffs were unlawfully imprisoned, the officers completed arrest paperwork which, upon information and belief, alleged that the Plaintiffs were observed smoking marijuana, by officer McDonnell. The officers forwarded knowingly false allegations to the DA or the criminal court in order to justify the arrest and to persuade the DA or the CC to commence and/or continue Plaintiffs' criminal prosecution. The DA initiated the prosecution based on the false statements made by the officers. At his arraignment, one Plaintiff accepted an adjournment in contemplation of dismissal. His case was subsequently formally dismissed.
