When Plaintiff opened the door, Defendant Officer Mercado immediately entered the apartment with Plaintiff's consent or permission. Defendant Officer Mercado immediately and unjustifiably grabbed Plaintiff by the wrist and handcuffed him. Plaintiff was the lawful tenant of the house and had paid rent for use of the apartment, as well as for utilities. Prior to August 2, 2019, Plaintiff had no outstanding rent payments and had, in fact, paid the full amount of rent in cash for the month of August 2019. Despite the Plaintiff having paid rent and having a legal right to occupy the apartment, defendant officers arrested him for trespass. Plaintiff was transported to the precinct, then to Central Booking and was charged with Criminal Trespass.
