When Plaintiff inquired as to the legal basis for the officer’s actions, Detective Luongo physically, excessively, and forcibly removed Plaintiff from his vehicle. Detective Luongo then forcibly dragged, accosted, assaulted, battered, threw, propelled, touched, grabbed, and pulled the Plaintiff. The officers then conducted an illegal and unwarranted search and seizure of Plaintiff, handcuffed him, placed him under arrest, and falsely charged him with 2 counts of criminal possession of a controlled substance in the seventh degree. Plaintiff was placed into a police van, which drove around excessively and aimlessly for approximately 4 hours. Plaintiff was finally taken to the 61st Police Precinct, where he remained incarcerated for an additional hour until he was released with a court date. The officers intentionally caused and bolstered a malicious criminal prosecution against Plaintiff.
