At the time and place of said arrest, Mr. Hyde and his partner that he was in need of medical attention and proceeded to display his injuries to the Officers – deep lacerations on his fingers due to bite wounds, bite wounds on his torso, and visible contusions to the torso, arm, and head. Officer Rivera and Officer John Doe #1 acted with deliberate indifference and denied Mr. Hyde access to emergency medical care for his serious medical needs – there was an EMS ambulance truck on the scene responding in tandem with the NYPD. \nMr. Hyde was subsequently placed in a holding cell for 3 hours and was subjected to threats of physical violence from Office Rivera and Officer John Doe #1 for his continued please for medical attention – Mr. Hyde was also subjected to humiliation and mocking with both Officer Rivera and Officer John Doe #1 calling him a “no good, faggot-ass nigga.” An ambulance was called and arrived at approximately 4:30 am on December 23rd, 2013. Mr. Hyde was escorted from the precinct house to the EMS truck by Officer Rivera, Officer John Doe #1, and EMS John Doe #2. Mr. Hyde was placed in the ambulance truck and strapped into his seat with his hands cuffed behind his back. Officer John Doe #1 subsequently stepped into the EMS vehicle and said words to the effect of: “So you wanna go to the hospital? I’ll give ya reason to go to the hospital.” Officer John Doe #1 subsequently began to punch Mr. Hyde in the head, the shoulders, and the torso. Mr. Hyde attempted to defend himself by raising his knees. In response to this, Officer John Doe #1 grabbed Mr. Hyde’s foot and twisted it with great force, causing severe pain and a severe sprain to Mr. Hyde’s ankle and a strain to his knee joint. Officer Rivera failed to intervene as was required by law and instead encouraged Officer John Doe #1 with words to the effect of: “Yeah!! Fuck ‘im up!! Break ‘is fuckin’ leg!!”. EMS John Doe #2 also failed to intervene despite being present and witness to Officer Rivera and Officer John Doe #1’s actions.
