Officer Tran Minh and officer Does 1-10 responded to a call for assistance due to a fight between two women at the location. Plaintiff was not involved in the fight. The officers attempted to arrest plaintiff, despite not seeing him involved in any criminal activity. As the officers attempted to grab him, numerous individuals yelled out that plaintiff hadn't done anything. Nevertheless, an officer grabbed plaintiff, violently threw him against a wall/gate, kneed him, and aggressively handcuffed him, pulling his arms violently back and upward. Plaintiff was screaming in pain and was placed in a patrol car with the windows closed. Plaintiff, who is claustrophobic, pleaded with the officers to lower the window, which they finally did after 10 minutes. Plaintiff wanted to go to the hospital but was dissuaded from going by an officer who told him he would be held longer if he went. Plaintiff was handcuffed to a pole at the precinct, then placed in a locked holding cell. He was held for 9 hours before being falsely charged with resisting arrest.
