The argument occurred after the store employee made inappropriate and racially disparaging remarks about the Plaintiff's wife. Without saying a word to the Plaintiff, Defendant officer Nelson and the officers in plain clothes took plaintiff in custody. Plaintiff's wife, who had been waiting in the car outside, entered the store and inquired about the situation after seeing her husband in handcuffs. Defendant officer Hernandez asked Plaintiff's wife to step outside and after she did so, kicked her to the ground and handcuffed her tightly behind the back. Plaintiff was then brought outside by defendant officer Nelson and struck in the back, causing him to fall to his knees. Plaintiff's wife was asked to get up, which she expressed that she was unable to do due to the handcuffs. Defendant officer Nelson then grabbed her breasts from behind and lifted her up. Defendant officer Nelson then searched the plaintiff's car without his consent and seized a canister of mace. An ambulance then arrived to take the plaintiff and plaintiff's wife to the hospital, where Defendant officer Nelson falsely accused plaintiff of being intoxicated. Defendant police officers Nicholas Nelson (badge no. 15798) and Jessica Hernandez (badge no. 25513) responding to the scene of the car accident, began verbally assaulting, abusing, and shouting at the plaintiff. Then defendant Nelson pushed and slammed the plaintiff against a brick wall. Defendants Nelson and Hernandez handcuffed plaintiff, turned plaintiff around, slammed him against the wall again, and threw his body on the ground. Defendant Nelson dragged plaintiff across the pavement to the curb, pulled him up, and slammed him onto the hood of the car. Defendant Nelson then dragged plaintiff to a police car, pushed half of plaintiff's body into the rear of the police car, and left plaintiff's legs outside of the car. Defendant Nelson made racial slurs referring to plaintiff's native country and national origin. Defendant Nelson then punched plaintiff in his abdomen and ribs while the plaintiff was handcuffed behind his back and torso was partially in the police car. While this was happening, defendant Hernandez sat in the front of the police car and verbally taunted plaintiff. A male police officer later responded to the scene and spoke to defendant Nelson in private. Defendant Nelson released plaintiff.
