The Plaintiff's friend was arrested. A second friend of the plaintiff existed the station and asked the police where the arrestee was to be taken. When the police were aggressive in response, the Plaintiff tried to diffuse the situation. The plaintiff was walking away with his second friend when the police began yelling at him. When the plaintiff asked the police to take it easy, he was arrested  without probable cause or reasonable suspicion by several officers including Defendant ANA D. CUAZ  (Shield # 29104). During the plaintiff's arrest, several police officers including Defendant Cuaz and Defendant P.O. YAUDY FERNANDEZ (Shield #3894) punched the plaintiff in the face causing bruising, swelling and broken blood vessels in the eye. The assault continued while the plaintiff was on the ground. Defendant Officers CHRISTOPHER GARCIA (Shield # 6086) and P.O. PETER THALL (Shield # 1665) witnessed the attack and failed to intervene. The plaintiff was transported to the precinct where the Defendants generated an arrest report including false allegations of criminal activity. The Plaintiff was held overnight prior to arraignment.
