(That same security guard had acted aggressively toward the plaintiff in that same store months prior.) \nWhen the police arrived, defendants Officers Yelena Ast and Rawdi Ali and Lieutenant Nakwan Brathwaite did not allow the plaintiff to file a report against the security guard, possibly due to the fact that the security guard was a former NYPD officer. As the plaintiff was attempting to exit the store, and in response to his saying he would file complaints against those three officers for refusing to take his report, one of the police officers present punched him in the back of the head, and then another - believed to be defendant Officer Russell Bast - sprayed him with pepper spray. He was then handcuffed and put into a police car, during which process he was forcefully grabbed in the head. The NYPD did not properly decontaminate him from the pepper spray until hours later, after first making him attempt to remove it himself with toilet water. After two hours, they brought him to a hospital emergency room for decontamination and to be examined due to other injuries. On October 20, the plaintiff was arraigned, charged for resisting arrest and trespass, and released on his own recognizance.
