The officers claimed to have observed Mr. McEachin in possession of a controlled substance; however, this assertion was later found to be fabricated. Mr. McEachin was arrested, subjected to a strip search at the 101st Precinct, and detained for over 24 hours before being arraigned and remanded to Rikers Island. He was indicted on November 21, 2013, based on false testimony. After 20 months of legal proceedings, including 24 court appearances, the charges were dismissed on May 29, 2015, following a suppression hearing where the court ruled that the officers lacked probable cause. Mr. McEachin alleges false arrest, malicious prosecution, excessive force, and denial of his constitutional rights, resulting in physical injuries, emotional trauma, and humiliation.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=Y24cV_PLUS_CrGhRs0ORuNY8fmQ==","type":"complaint"}]},{"name":"Christopher, Wayne vs City of New York, et al.","start_date":"2013-10-28","disposition_date":"2014-05-14","payout_amount":18000,"disposition":"Settlement","docket":"13CV05655","court":"U.S. District Court - Eastern District NY","officer_name":"Hillmann, Brian","summary":"On February 2, 2012, Defendant police officers drove up to a Brooklyn street corner, where Plaintiff stood, eating a sandwich and conversing with friends, and ordered Plaintiff to place his hands on the window of a nearby liquor store. Plaintiff peacefully complied with the officers’ orders. Defendants then handcuffed Plaintiff, slammed Plaintiff’s head onto the hood of their police car, emptied Plaintiff’s pockets, and retrieved Plaintiff’s identification and $20 in cash, all without permission or authority. At no time during or subsequent to his arrest was Plaintiff read his Miranda rights. Plaintiff was then transported to the precinct for processing, where he was informed that the reason for his arrest was because he allegedly sold drugs to Michael Harding, a friend of the Plaintiff and a man whom the Plaintiff handed a cigarette to shortly before his arrest. Plaintiff denied ever having sold Mr. Harding any drugs, and Mr. Harding corroborated Plaintiff’s story. Nevertheless, at the precinct, Plaintiff was forcefully strip-searched in an open area—that is, made to strip naked, bend over, squat, and cough in front of strangers not participating in the search—and was charged with criminal drug possession with intent to sell and criminal sale of a controlled substance—both felonies—as well as criminal possession of a controlled substance—a misdemeanor. Plaintiff did not have the means to afford bail, so he was forced to endure 14 days of incarceration at Riker’s Island. On or about February 8, 2012, the felonies were dropped, as there was no evidence to suggest Plaintiff had ever possessed or sold any narcotics. Plaintiff’s misdemeanor case remained pending for 6 additional months, after which his case was adjourned in contemplation of dismissal.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.347858/gov.uscourts.nyed.347858.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13050245/christopher-v-city-of-new-york/"},{"officer_name":"Hillmann, Brian","disposition":"Settlement","start_date":"2012-12-17","disposition_date":"2013-07-11","court":"U.S. District Court - Eastern District NY","docket":"12CV06150","name":"Dawson, Jason vs City of New York, et al.","payout_amount":22500,"url":"https://www.courtlistener.com/docket/12958141/dawson-v-city-of-new-york/"}],"id":"B4AR","url":"https://www.50-a.org/officer/B4AR"}
