At 1:30AM, plaintiff received a call that her son was shot outside their home. Plaintiff rushed home. Outside her home were many police officers. Her son was already at the hospital. Plaintiff was taken into the home and questioned for an hour. Plaintiff learned her son was alive but shot several times. Officers later left her home except for an officer who remained outside. Plaintiff exited her home to go the hospital and noticed her son's bag lying on the sidewalk. Plaintiff asked the officer if she could take the bag as it contained personal items. The officer told her to wait. 30 minutes later plaintiff again asked the officer if she could take the bag. The officer took plaintiffs name and date of birth and plaintiff left for Brookdale Hospital. At Brookdale, several officers were outside her son's room. Plaintiff later walked out of the trauma room and was approached by several officers. Outside the hospital, plaintiff was told she was under arrest. She was grabbed by several officers, handcuffed and put into a police car. The car drove away from the hospital and stopped a few blocks away, where plaintiff was removed from the car and searched. Officers emptied her pockets, and searched her wallet, with no contraband found. Plaintiff was taken to the precinct, searched again and chained to a bench. She was taken back to Brookdale to receive treatment for injuries. Plaintiff was released from the precinct with a Desk Appearance Ticket.
