Andrukiewicz and her son were attacked by another group at the playground. Officers Hendrick and McGuire arrived at the scene to investigate. Andrukiewicz's husband told the officers that Agnieszka speaks limited English, and requested a Polish-speaking officer. The officers refused. Lieutenant Moye arrived at the scene, and again tried to interview Andrukiewicz in English. The officers then arrested and handcuffed Andrukiewicz. Andrukiewicz was in custody at the precinct for two hours before release. Andrukiewicz was charged assault in the third degree, endangering the welfare of a child, and harassment in the second degree. Officer Hendrick falsely stated that these alleged crimes were committed against Noel Jasaida, who does not exist. POs caused a malicious prosecution to be commenced against Plaintiff.
