P.O.s asked the plaintiff for his ID, which Plaintiff provided, told him he is going to jail, and then proceeded to issue a summons. Plaintiff asked if he could go to his residence and get his bike and his backpack that was unattended on the sidewalk. Plaintiff walked down the sidewalk to his residence and got his bike and backpack and began riding it back to the P.O.s, and suddenly and without warning, one of the P.O.s charged at Plaintiff and tackled him off of his bike, despite Plaintiff’s clear intentions of coming back to receive his Summons and ID. The P.O.s then physically assaulted Plaintiff with their fists, feet, and batons. They dragged Plaintiff over to where there was a pile of black garbage bags on the edge of the sidewalk and pushed his face into the plastic bags, causing him to be unable to breathe. Defendant P.O. Donnelly, who had been drinking late into the night, made forcible entry into Plaintiff’s apartment while Plaintiff screamed, telling him o get out. Officer Donnelly approached Plaintiff in her bedroom, grabbed her, and threw her to the ground. He struck her in the head 20-30 times, accusing her of having guns and kids, and calling her an “ACS bitch.”  The attack on Plaintiff mirrored a separate arrest Officer Donnelly conducted the Friday before, in which to recover a firearm, Officer Donnelly brown down a door and saw the suspect inside with young children. He demanded that the suspect turn over the gun, indicating he did not want to have to contact ACS. When Officer Donnelly turned away to search Plaintiff’s dresser, she escaped and fled her apartment. Plaintiff ran down the hallway, knocking on neighbors’ doors for help, but no one came to her aid. Plaintiff fled down the stairs. \nOfficer Donnelly exited the building and eventually regained entrance. He pounded on Defendant P.O. Ryerson’s door, who lived in Plaintiff's building, until Ryerson’s then girlfriend let him in. Officer Donnelly went to sleep in Ryerson’s apartment. Plaintiff called the police, who arrived and canvassed the apartment for witnesses and potential suspects. A wanted poster was prepared by which Defendants should have known that Officer Donnelly was a suspect. No one reported Officer Donnelly as a suspect, and on June 14, 2014, Internal Duty placed him on modified duty, seizing his firearms and shield. They assured him that “everything is going to be OK, there is counseling for this,” referring to his longstanding issues with alcoholism and sleep disorders. Officer Donnelly completed an in-patient treatment at a rehab facility for alcoholism and PTSD related issues. On August 4, 2014, Officer Donnelly was arrested and initially charged with counts of burglary, trespass, and harassment. He was indicted on September 29, 2014.
