After Andre confirmed his identity, the officers asked him to place his hands behind his back, and without providing reason for the arrest, immediately took him to ground.  Defendant officer Tracey Duncan began to beat Andre with a police baton about the head, legs and body.  Defendant officer Luis Machado was present on the scene and stated to the officer striking Andre that “I have the defendant under control.”  Defendant officer Christine Damico was also present and failed to intervene in Duncan’s actions.\n\nThe officers lacked justification, probable cause or reasonable suspicion to detain and imprison Andre.  Andre was taken to the 71st Precinct despite clearly visible injuries.  While at the precinct, Andre asked Machado for medical treatment but his requests fell on deaf ears.  After roughly 7 hours at the Precinct, Andre was taken to Brooklyn Central Booking. When asked for a warrant, Defendant Officers threatened to cause the loss of the plaintiff's home, arrest the entire family and/or unleash police dogs. The Defendant Officers proceeded to tear the home apart in search of guns. None were found. Plaintiff 1 was interrupted while using the toilet and forced to sit in handcuffs without having cleaned himself for nearly an hour. \nOn December 13, 2012 at 8:20AM, Defendant Officers entered the plaintiffs' home and arrested Plaintiff 1 without probable cause or reasonable suspicion. They proceeded to search the home for marijuana without a search warrant. No marijuana was found. Plaintiff 1 was falsely charged with marijuana possession.
