After Defendant read Plaintiff his Miranda rights, Plaintiff requested a lawyer be present during questioning, but Defendant denied Plaintiff's requested and arrested him for Second Degree Attempted Robbery without a warrant. The grand jury did not indict Plaintiff based on lack of probable cause. Plaintiff was held on $75,000 bail after his initial arraignment and was never produced in court again. On December 15, 2010, Plaintiff violated his probation, and was sentenced to 1-3 years in prison based on his open attempted robbery case. That case was eventually dismissed in favor of the accused on August 19, 2011 without the knowledge of Plaintiff, and Plaintiff was never notified about the dismissal.
