PO Sanchez exited the vehicle wearing plain clothes and told the Plaintiff to approach. There was no visible marking that the Officer or the vehicle was NYPD. Out of fear for his life, the Plaintiff ran away and PO Sanchez started to chase him. PO Herrera, who was also in the car, got out to help PO Sanchez. PO Hughes was the driver, who also pursued the Plaintiff while in the car. It was only when the Officers caught the Plaintiff, that they told him they were NYPD and put him in handcuffs. They did not tell the Plaintiff why he was under arrest. Sgt. Demonda approved of the arrest, despite the manufactured evidence against the Plaintiff. Later, the Plaintiff was told he was arrested for alleged possession of a firearm, which he did not possess. PO Herrera signed a criminal complaint that stated the Defendants had observed the Plaintiff urinating on a public sidewalk and also dropped his gun to the ground. Both allegations were false.
