Harvey was properly near New York Ave. and Foster Ave. of Brooklyn when the officers improperly stopped, questioned, and arrested Harvey without a probable cause. At no time did the Harvey possess a weapon or provoked the officers or consent to the arrest. The officers, however, negligently slammed Harvey to the ground, severally injuring Harvey. The officers then provided false, misleading, and incomplete information during the prosecution to the Kings County District Attorney's Office, denying Harvey his right to a fair trial. Furthermore, the officers did not intervene. All charges against Harvey was subsequently dismissed.
