As he approached his building complex, a car cut him off. Three police officers in plain clothes exited the car and surrounded Mr. Whitaker. They did not identify themselves as police officers. The officers asked Mr. Whitaker where he was coming from and if he was carrying any weapons. He told them where he was coming from and that he was not carrying weapons. One of the officers then took Mr. Whitaker's dog up this apartment. Mr. Whitaker asked the remaining two officers why he was being detained, but they did not answer him. The officers intrusively searched Mr. Whitaker on the public sidewalk, including pulling down his pants and touching his buttocks and private parts. Though Mr. Whitaker cried out for the officers to stop strip-searching him on the sidewalk, they did not stop. Instead, they violently assaulted him. One officer grabbed his shirt and choked him while another bent his finger. The officers punched and kicked him all over his body, including his face, head, and stomach, and also bent and twisted his fingers. The search of Mr. Whitaker did not uncover anything illegal on his person. Mr. Whitaker was then thrown into a police car, handcuffed, and beaten again while lying on the back seat of the car. He asked to be taken to the hospital for treatment, but was ignored for several hours. He was transported to the police precinct, and later to central booking. Mr. Davis regularly played chess in Fulton Park and had recently completed a game of chess when the defendants entered the park. After one of the officers falsely claimed Mr. Davis had marijuana, he was detained, questioned, searched and arrested, on the false claim that he had destroyed marijuana. At the 81st Precinct Stationhouse, defendant Hirsch, prepared or allowed to be prepared false police reports accusing Mr. Davis of attempted tampering with evidence. While at the Stationhouse, one or more of the defendants caused Mr. Davis to be strip-searched. While Mr. Davis was awaiting arraignment, defendant Hirsch caused false statements to be made to the Kings County District Attorney's Office. After approximately thirty hours in custody, Mr. Davis was arraigned on the false charge, released and required to appear in Criminal Court.
