Plaintiff's disgruntled ex-boyfriend had called the police and falsely claimed that plaintiff was overdosing on drugs that day. Four NYPD officers—Ofc. Eric Dipaolo, Ofc. Joseph Manni, Ofc. Tyler Dowen, and Ofc. Vicente Cardenas—showed up to plaintiff's apartment without warrant. They stated that they were responding to a report that plaintiff was overdosing. Plaintiff spoke to officers with the door open and explained that the report was false. She showed no signs of an overdose and had not consumed any illicit substances. Other guests told the officers that there was no overdose. During the conversation, Ofc. Dipaolo placed his foot by the door inside the apartment. Plaintiff repeatedly asked him to remove his foot, but he did not. Ofc. Manni asked for plaintiff's identification and plaintiff provided it. The officers insisted on searching the place to make sure everyone was OK. The conversation escalated and plaintiff asked Ofc. Dipaolo to remove his foot so that she could close the door and get her ID. He refused. When plaintiff tried to close the door, he pushed it open, stepped inside, and grabbed plaintiff. He pulled her out of the apartment with the assistance of Ofc. Manni. The officers surrounded plaintiff and tightly handcuffed her, ripping into her skin and causing pain. Plaintiff asked why she was being arrested and Ofc. Dipaolo stated that she was obstructing governmental administration. \n\nOfficers Cardenas and Dowen entered plaintiff's apartment after she was handcuffed and searched the apartment, finding nothing. They took plaintiff downstairs and put her in an ambulance and took her to the hospital.
