The detective requested the Plaintiff's address, which he provided. The detective later arrived at the Plaintiff's residence and requested the Plaintiff come outside to view photos of the accident. The Plaintiff complied. The detective then asked the Plaintiff to confirm his name and show his ID. The Plaintiff complied. The Plaintiff was then surrounded by two other detectives and who ordered the Plaintiff into an unmarked van. The Plaintiff asked why but was ignored. The detectives then grabbed the Plaintiff and threw him into the back of the van, resulting in the Plaintiff hitting his head hard on the back set. The Plaintiff was then transported to the 108th precinct, where he was unlawfully searched, seized, detained and arrested. The Plaintiff was detained for approximately thirty-two (32) hours. During his detention the Plaintiff was denied access to the bathroom. The Plaintiff was then transferred to central booking where he was held overnight and the followign day before being released without any formal charges laid. The OLP policy strictly requires officers to be recording the conversations. P.O. Sterling, without recording, started a conversation with Plaintiff and offered to perform oral sex on him for money. Plaintiff declined and she walked away. Her supervisors, P.O. Matthew Sepe and Frank Dipreta heard the conversation in real-time through a speaker in their police car and knew that Plaintiff had not committed a crime. However, Plaintiff was still handcuffed and arrested despite no probable cause at all. P.O. Sterling a false supporting deposition claiming that Plaintiff had solicited prostitution and contained alleged inculpatory statements, and caused it to be forwarded to the DA's office.
