The taxi was pulled over by an unmarked car operated by officer's Urbanek and Santiago.  Plaintiffs were not committing nay crime at this time , simply passengers in a taxi. The officer's approached the taxi to speak with the passengers.  Urbanek approached the side of the taxi where Julian Rivera was seated and opened the door.  Urbanek ordered Rivera out of the taxi . According to the sworn testimony of P.O. Urbanek, Rivera exited the vehicle , he reached into his pocket and retrieved a pistol, which he threw on the seat of the vehicle.  The pistol was recovered from the seat of the vehicle by Officer Santiago.  According to testimony from Santiago , during this time plaintiffs were sitting in the vehicle with their hands in their laps\" Plaintiffs were dragged out of the vehicle and slammed to the ground and beaten . At no time during this incident did plaintiffs commit any crime.  Despite these facts plaintiffs were arrested and charged with Criminal Possession of a Weapon in the Second Degree.  Plaintiffs both spent over 24 hours in custody .
