Upon information and belief, the officers arrived at the location in response to Plaintiff’s request, made during the aftermath of Hurricane Sandy, that officers assist with traffic congestion caused by vehicles waiting to obtain fuel. An officer kept pushing the wife away from her home. Eventually the pushing caused her to fall, striking the outer wall of the building. The husband then stated, in sum and substance, why are you touching my wife? After the officers thereafter had ordered the husband off the corner, and he too had explained that he lived at the location, three officers grabbed him, took him to the ground, stepped on his ankle, kneed him in the leg, placed handcuffs on his wrists, and continued to step on and knee him while he was on the ground. Thereafter, the wife was punched in the back and sprayed with mace. She was taken to the ground, and multiple officers participated in mashing her face into the concrete, twisting her arms behind her back, handcuffing her in an overly tight manner, and placing knees and feet on her body. She also felt approximately two kicks to her back. \n\nPlaintiffs were taken to the precinct, and the officers who transported the wife caused her head to strike the police car vehicle when they forcefully placed her inside the vehicle. During transportation they swore at her, and called her a bitch. Plaintiffs were imprisoned until the next day, when they were arraigned on baseless charges. The charges were based on false allegations made by officer Timothy Lake.
