During the attack, Defendant Monk repeatedly referred to plaintiff as a “NIGGER.” In response to a FOIL request, the fire department stated that they “are not aware of Fire Prevention Inspector Monk having attended any training relating to workplace violence.”\n\nTwo separate ambulances arrived at the scene in addition to two Supervisory NYPD Officers, Defendants Richard Roe(s) and/or Jane Roe(s). Plaintiff told personnel from both ambulances and the supervisory officers that he had been assaulted. Additionally, Plaintiff tried to make a report with the supervisory officers. However, the officers did not allow Plaintiff to make a report and instead conspired with other officers and the ambulance personnel to cover up incident. (Specifically conspiring with Defendant Fire Prevention Inspector Eric Monk, Defendant Roes, Defendants Smithu, Baronette, Singh, Sudes, Lt. Kahn, and the Internal Affairs Bureau).\n\nAfter the attack, Plaintiff was taken to the hospital. While there, plaintiff was arrested by Defendant PO Samuel Smithu without a warrant, who listed Plaintiff’s physical condition as “apparently normal” despite his injuries. Smithu told Plaintiff that he had been ordered by his supervisors to arrest plaintiff. The charges against Plaintiff were maliciously and falsely lodged complaints brought by one or more of the individual defendants.\n\nOn July 9, 2013, the plaintiff was arraigned, and the People’s Disclosure attributed false statements to plaintiff while not retaining a video of the incident. On September 25, 2013, the charges against Plaintiff were dropped by the DA. \n\nOn October 12, 2013, Plaintiff went to the 70th Precinct in order to file a criminal complaint against Defendant Monk with intake officer P.O. Kaufmann. However, Sergeant Baronette disallowed Kaufman from making the report, saying he had been directed to do so by Sergeant/Lt. After being held in the precinct overnight, plaintiff was taken to Brooklyn Central Booking for 30 hours in custody. Plaintiff was arraigned in Kings County Criminal Court and released on his own recognizance. Plaintiff was compelled to return to Court several times to defend against the false charges. On motion of the District Attorney, the charges were dismissed on October 3, 2013. Plaintiff suffered damage as a result of defendants’ actions.
