Plaintiff was transferred from the precinct to Central Booking where he was arraigned on a criminal complaint made on the basis of false allegations supplied by the defendants that Plaintiff was indicted by Defendant Laspina for the criminal offense of burglary on or about September 9, 2019; and that on April 14, 2020, they observed Plaintiff committing another crime or violation of the law which both were made without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification. PO Defendants also, while Plaintiff was in custody, prepared and filed false paperwork with the DA. As a result, Plaintiff was caused to be incarcerated over the course of approximately 1 year until his release eventual from physical custody on, or about, May 1, 2021. Several minutes later the defendant officers approached the Plaintiff and his friends, unlawfully asking them to produce their identification and ordered them to disperse. The Plaintiff told the officers that other officers had just allowed them to remain in the area and socialize and there was no reason to force them to provide identification. The officers aggressively continued to demand identification and for them to disperse. In fear, the Plaintiff started leaving the area when the officers pursued and assaulted him by tackling him to the ground and causing him to suffer physical injuries throughout his body. The officers unlawfully handcuffed and falsely arrested the Plaintiff without probable. The Plaintiff was transported against his will to the 81st Precinct where he was unlawfully searched, fingerprinted, photographed and detained in a filthy holding cell for many hours. The officers falsified allegations against the Plaintiff to avoid being disciplined for falsely arresting him and charged him with assaulting a police officer. Thereafter, the plaintiff was transported to Kings County Central Booking where he was unlawfully detained for many hours. On May 4, the Plaintiff was released from custody from Central Booking without appearing before a judge, and without being charged with and/or criminally prosecuted for committing any crime.
