The Plaintiff was then taken to Central Booking to await arraignment.\n\nWhile in Central Booking, Defendant Lallave and Defendant Maloney conveyed false information to prosecutors, in order to have the Plaintiff charged with: Criminal Sale of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Fifth Degree, and Criminal Possession of a Controlled Substance in the Seventh Degree. The Plaintiff, who did not possess or sell heroin or engage in illegal conduct on April 19, 2013, was arraigned on those charges and spent approximately 30 hours unlawfully in police custody. At arraignment, the Honorable Judge Parker released the Plaintiff on his own recognizance and the matter was adjourned for grand jury action. On June 6, 2013, the Plaintiff was indicted by a Kings County grand jury.
