When he opened the door, he saw the NYPD defendants, specifically Officer Budney and Detectives McCarthy, Halinski, Erlich, McGuinness, Difrancessa, Hefner, and Gezurian.  The NYPD defendants entered the residence and subjected the plaintiff to several forms of physical force, including pushing him against the wall, punching his back, kicking him when he fell to the floor, and punching his face, causing a bleeding lip.  As a result, the plaintiff suffered physical injury.  The NYPD defendants took the plaintiff to a precinct where he remained in custody before his transfer to a booking facility.  The plaintiff was unable to go to a hospital to treat his injuries until the following day. Eventually officers used a blade to cut open to door and cut Plaintiff multiple times. Once they entered, they used excessive force and tasers to arrest him, take him into custody, and bring him to the hospital. Defendant NYPD officer Anthony Difrancesca aggress rode his police scooter into Douglas, causing him to fall down and ran over his leg. Difrancesca stopped his scooter while it was on Douglas' right foot and got off it. Douglas kicked the scooter off him and a number of John Does police officers, including  Jerome Allen and Sergeant Brian Byrnes, manhandled Douglas using police batons and banged his head on the roadway. They also pulled his arm up and out, handcuffed his with plastic handcuffs, and threw him onto the floor of a police transport vehicle. After being transported to the Precinct, plaintiff was then taken to Bellevue Hospital to receive medical care. After plaintiff was taken back to the Precinct, a John Doe member of the Internal Affairs Division took photos of his face with the cell phone and badgered him to remove his bandages, despite plaintiff repeatedly asking for an attorney. Plaintiff was also denied the privilege of making a phone call for an inordinate period of time.  \n\nDouglas was originally arraigned the next day on a felony criminal complaint of one count of Criminal Mischief in the Third Degree and one count of Resisting Arrest. Officer Allen falsely attested that they arrested the plaintiff after he kicked over an NYPD vehicle and that plaintiff resisted arrest by flailing his arms and kicking his legs. Then a misdemeanor complaint was lodged against the plaintiff on October 24, 2011, in which he was charged with Criminal Mischief in the Fourth Degree and Resisting Arrest. In this complaint, Difrancesca attested that Sergeant Brian Byrnes observed plaintiff kick over the motorcycle and resist arrest by kicking his legs. Byrnes submitted a supporting deposition. When plaintiff returned to the Precinct to collect his belongings after being released, he found his electronic devices had been shrink-wrapped, indicating they may have been unlawfully searched.
