Subsequently, defendants performed an unlawful search in an invasive and destructive manner, before allegedly recovering contraband from a safe located therein. On January 26, 2022, plaintiff-Perry was released from physical custody.  On September 1, 2022, all adverse charges pertaining to Plaintiff-Perry were dismissed and sealed on the merits. On December 22, 2022, plaintiff-Ellington was released from physical custody. During the pat-down, Officer Gonzalez reached into the front of plaintiff's pants, and when plaintiff objected, Officer D'Ambrosio grabbed and twisted plaintiff's arm and informed him that he was under arrest.  When plaintiff asked why he was being arrested, Officer D'Ambrosio punched him in the face.  Plaintiff fell to the ground, and officers Gonzalez and D'Ambrosio, along with several other officers, continued punching and kicking him.  He was handcuffed and taken to the 71st Precinct, where Officer D'Ambrosio began choking plaintiff while Officer Gonzalez pulled down his pants and underwear and lifted plaintiff's testicles with his hands.  Plaintiff was charged with resisting arrest and riding a bicycle on the sidewalk.  As a result of the incident, plaintiff suffered injuries to his head, left eye, back, neck, and shoulders. Defendant officers continued their conspiracy by preparing false documents and reports to be presented to both the Court as well as to the Brooklyn District Attorney's Office.
