As a result, the Judge set bail to an amount the Plaintiff could not make and Plaintiff was held until August 18 before being released. Plaintiff spent $10,000 on a private defense attorney to fight the false allegations. P.O.s continued to repeatedly raid Plaintiff’s cellphone store, raiding it two times in the ensuing six months after his false arrest. On April 10, 2011, the plaintiff was arraigned in criminal court. The plaintiff knew he did not sell drugs, but still accepted a plea deal at his lawyer's persistent urging and was thereafter convicted and sentenced to 1 year at Rikers Island Correctional Facility. While at Rikers, the plaintiff was subject to gang violence, solitary confinement, and other physical and mental mistreatment. On April 24, 2019, Detective Joseph Franco was indicted on at least 16 criminal counts, which included perjury and official misconduct, specifically in relation to the drug-related arrests he made during his career with the NYPD. Detective Franco and other defendant POs took the plaintiff off the streets and grabbed him by the arm. Outside the bodega, defendants then searched and handcuffed the plaintiff and then transported the plaintiff to the 40th Police Precinct, where the plaintiff was searched and photographed. Around $600 cash was taken from plaintiff's person. Plaintiff was interrogated without Miranda warnings or an attorney present by Detective Franco. Plaintiff was transported to Central Bookings and the went before a judge. The defendants provide false information for the prosecution that the plaintiff was engaged in possession of a controlled substance and related offenses. Plaintiff was unable to make bail for around 30 days, during which he was housed pre-trail at Riker's Island. While at Riker's Island, plaintiff was not given any of his prescribed medication. Upon release, plaintiff was told by his public defender that he would get years in prison if he did not plead guilty although plaintiff told his defender he was innocent. On March 8, 2016, plaintiff entered a plead guilty. Detective Franco's perjury arrest caused the Bronx County District Attorney's Office to re-investigate plaintiff's arrest, incarceration and conviction. The plaintiff and his friend started to cross the street and were almost struck by an unmarked vehicle. Two defendant POs were rolled down the windows of the vehicle and told the plaintiff that he and his friend matched a description for a crime an that they need to search them. Plaintiff and his friend were then subject to pat-down search and arrested the plaintiff restraining him with metal handcuffs. Defendant POs then placed plaintiff in an NYPD van and transported to the 67th Precinct. The plaintiff was subject to strip search in the cell and was taken into an interrogation room for around 45 minutes. After around 48 hours in a cell at the 67th Precinct, plaintiff was transported to Kings County Central Bookings, and then remanded to Rikers Island Correctional Facility for around 72 hours to await his court date. On March 19, 2005, the plaintiff was arraigned in criminal court and released on his own recognizance. After leaving court, plaintiff headed back to his home but was spotted and grabbed and arrested again by defendant POs. Once in handcuffs, the plaintiff was dragged around the corner by defendant POs, who proceeded to beat him for around half an hour, punching him repeatedly in the face and torso. The plaintiff was transported to the 67th Precinct again and he requested for medical treatment but was denied. The plaintiff was again transported to the Kings County Central Bookings and was arraigned in criminal court after 48 hours custody and was again released on his own recognizance. On May 4, 2005, the defendant PO followed the plaintiff inside the apartment building, one of the defendant POs smashed a bottle against the wall, a neighbor saw what hanppended, and the defendant POs pulled a gun on her. The plaintiff put himself between the gun and his neighbor, and he was grabbed and dragged to the elevator by the defendant POs. Defendant POs arrested the plaintiff again and dragged him outside the building and placed him in a NYPD van. Once inside the van, three defendant POs began to punch and kick the plaintiff. The plaintiff was transported to the 67th Precinct and was transported to Kings County Central Bookings. On May 5, 2005, the plaintiff was arraigned in criminal court and was reminded to Rikers Island Correctional Facility. The plaintiff remained in custody at Rikers for the next 14 months while he made regular appearances in court. The plaintiff was convicted as a result of detective Franco's false testimony against him and sentenced to three and half years as a combined sentence for the false charges made against him on March 13, March 19 and May 4, 2005. The plaintiff was released on parole on March 14, 2008. On July 13, 2012, the plaintiff was picked up on a parole violation related to his 2005 conviction and was ultimately made to serve almost two more years. On February 14, 2014, the plaintiff was released. The Individual Defendants fabricated evidence against Plaintiff and another person Miller, including sworn allegations that Defendant Detective Joseph Franco “Miller speaking to SCD Emanuele Gelsomini.” Defendant Franco further informed co-defendant police officers that he “then observed SCD Gelsomini hand Miller US currency” and then “observed Miller walk away from the location.” According to Defendant Officer Sean Brown, he observed Mr. Miller hand Plaintiff US currency in exchange for small items on the northwest corner of 2nd Avenue and 3rd Street, New York, New York. Defendant Brown also alleged several other events. He stated that Defendant Franco informed him of observing Mr. Miller return to SCD Gelsomini and hand him several small items. Brown also claimed that he personally recovered a hot crack pipe containing residue from Mr. Miller’s left front pants pocket. Additionally, Brown alleged that Defendant Payano informed him of stopping SCD Gelsomini and recovering two twists containing crack/cocaine from his fanny pack. He further alleged that Defendant Assent informed him of recovering $27 from Plaintiff Lamont Brooks’ left front pants pocket and marijuana from his right front pants pocket. \nThe Defendants also unlawfully engage in excessive, unlawful physical contact with the Plaintiff on the same day during the process. For approximately six days, the individual Defendants and others falsely stated and swore that Plaintiff committed criminal acts constituting the sale of a controlled substance in the third degree. They maintained those false claims in documents given to prosecutors that led to Plaintiff’s prosecution.  Only when Plaintiff's criminal defense attorney obtained video footage during the course of the criminal prosecution was the case dropped and Plaintiff's liberty restored.  Plaintiff was continuously kept in unlawful police custody until August 22, 2017.
