Segeant Pinny assaulted the Plaintiff, forcefully grabbing his hands and putting handcuffs on his left wrist at which the second male officer came up behind him and grabbed his right arm attempting to put the cuffs on his right wrist, but the first male officer was now bending his left arm in a clockwise motion while tightening the handcuff to his left wrist, cuffing him in an excessively tight manner. The tightness caused blood loss to the hands and numbness, bruising and internal derangement to his left shoulder. Plaintiff had not resisted or assaulted the defendants in any way and such forced as was used against him was unnecessary, unreasonable and excessive. Defendants had intentionally provided false information to the Bronx County District Attorney and offered false, fraudulent and misleading testimony to the grandy jury convened to investigate the charges against Plaintiff to ensure that he was indicted. Plaintiff was arraigned and formally charged with three (3) counts of Criminal Conspiracy in the First Degree, three (3) counts of Criminal Conspiracy in the Second Degree, one (1) count of Criminal Conspiracy in the Third Degree and one (1) count of Criminal Conspiracy in the Fourth Degree. Plaintiff was unable to meet his bail conditions and was remanded to custody at Riker's Island, where he remained for 11 months until he was released on bail in March 2015. During his incarceration on Riker's Island, Plaintiff was forcibly subject to multiple strip searches with cavity inspections. These officers then surrounded the minivan and asked for license, registration, and proof of insurance. The NYPD officers then asked for the names of each of the plaintiffs in order to run a \"warrant check\" against them. They did not find any warrants out for any of the plaintiffs. Despite this, the officer arrested them stating that because they were \"three Spanish males in a van\" they must be gang members. Officers then searched the van without a warrant or consent while Plaintiffs were handcuffed and positioned so that they could not observe the officers' search. One officer purported to have found a knife, yet they refused to show it to plaintiffs. The plaintiffs were then transported to the 52nd precinct by Officer Jose Cepada who refered to them as gang members. The arrived at the precinct where they were searched, fingerprinted, photographed, and had their eyes scanned. Attendant officers provided no warrant for their unlawfully entry, nor were they given permission by Plaintiff to enter. PO's told Plaintiff that they smelled marijuana. PO's began to search the home and Plaintiff told them to leave and attempted to call 911. One of the officers forcibly took her phone and proceeded to affix handcuffs to her wrists. During the search of Plaintiff's son's bedroom, one of the officers found marijuana and a firearm. Plaintiff was placed under arrest and transported to the 73rd Precinct. \nPlaintiff was processed and detained in a holding cell. While in the cell Plaintiff began to suffer from an anxiety attack. She asked for medical assistance and for something to eat and drink, but her pleas were ignored. After asking for medical attention a second time and being verbally abused by an attendant officer, Plaintiff began to vomit. Plaintiff was then transported to Brookdale Hospital via ambulance. She was treated at the hospital and then sent back to the Precinct. At arraignment Plaintiff was charged with possession of a firearm and possession of marijuana. After 13 hours in NYPD custody Plaintiff was released on her own recogniznce. The officers fabricated paperwork and falsified documents stating that Mr. Copes was in possession of a weapon and had resisted arrest along with committing other offenses.
