Donrick woke up when he noticed the subway was not moving. The defendant uniformed officers, were holding the subway car doors open, and signaled to Donrick to come to them. Donrick walked to them. The police told Donrick to leave the subway car. Donrick left the subway car. Officers asked Donrick for his ID and if he had any warrants. Donrick produced his identification and told them that he had no warrants. Donrick sat on a bench and reached into his pocket for his phone. Defendant Stokes told Donrick to take his hands out of his pockets. Donrick did so. Another officer demanded Donrick put the phone away, grabbed the phone and rushed Donrick. The police grabbed, yanked and bent Donrick's arms, and jumped on and pinned Donrick. Officers twisted Donrick's arms and placed excessively tight handcuffs on his wrists. After Donrick was handcuffed he complained, and one officer grabbed Donrick by the hood of his jacket and flung him around. When Donrick did not fall to the ground, the police pinned Donrick against the bench. Officers searched Donrick's bag. Officers kept Donrick on the platform and refused to provide him with their names and badge numbers. Donrick was transported to the 32nd Transit District, then to Central Booking for arraignment, and was released. Officers, including Igityan, falsely and maliciously told the Kings County DA the plaintiff committed various crimes, including resisting arrest and disorderly conduct charges. The criminal case against plaintiff was dismissed in its entirety. On October 25, 2012, the resisting arrest charge terminated.
