POs Jermaine Taylor and Angelo Pizzarro testified. At the conclusion of the hearing, the trial judge refused to suppress the alleged gun. On December 3, 2013, Plaintiff’s criminal defense counsel provided the trial judge evidence of possible perjury by PO Pizzarro. The hearing was re-opened on December 4, 2013, to allow Plaintiff’s defense counsel to question Pizzarro about the newly discovered evidence. At the conclusion of the hearing, the presiding judge ruled that PO Pizzarro’s testimony was “bizarre and implausible,” reversed his prior decision, and the case was dismissed. On June 22, 2013, the New York City Police Department Controlled Substance Analysis Section performed a Gas Chromatography/Mass Spectrometry analysis of the alleged methamphetamine.
