Plaintiff was carrying his fiancée's New York City Corrections Department issue badge identification, her wallet and other of her personal belongings, which his fiancée had accidentally left in his automobile and which he had held on his person to safeguard them.  Upon finding the identification did not belong to the plaintiff, he was detained by the defendants and told that if he moved, he would be arrested and/or forcibly detained.  Plaintiff explained the circumstances of his possession of the identification and the other items, but was arrested and charged with Criminal Impersonation in the Second Degree.  Defendants knew or had reason to know that Plaintiff had a serious heart condition and was required to undergo surgery for this condition.  Irrespectively of that, defendants employed excessive force in the detaining, handcuffing and restraint of plaintiff.  Amongst other things, Plaintiff’s false arrest strained his relationship with his fiancée, caused him to be unavailable for his children and rendered him unable to obtain and take his required medication for the day of his arrest. As a result of his arrest and restraint, plaintiff underwent severe chest pain, shortness of breath and extreme emotional distress as a result of defendants mistreatment and restraint.
