Officer Denis O'Hanlon, although hearing Plaintiff's ex-partner admit that Plaintiff was never physically abusive, engaged in the same confirmation bias as Officer Driscoll and failed to void Plaintiff's arrest. As a result, Plaintiff was suspended without pay for 30 days. He was charged for four misdemeanors and violations, in which three were dismissed and one he pled guilty to. Plaintiff was restored to duty on modified assignment. \n\nOn or about September 28, 2022, Plaintiff was falsely arrested by Officer Elvis Cornea based on text messages exchanged with Plaintiff's ex-partner. Plaintiff disagreed with his ex-partner regarding the health, safety, and welfare of their minor children, and criticized her over text. Officer Elvis falsely arrested him due to confirmation bias related to his gender and race as the aforementioned text messages are not \"objectively\" violative of any law or court order. Officer James Wilson also failed to void the false arrest because he engaged in the same confirmation bias. Plaintiff was suspended without pay for 30 days, and was restored to duty on modified assignment. The plaintiff asserted he had paid for the beer and that the surveillance video from Howard Deli would confirm his purchase. The officers instructed the plaintiff to stand and approach them, to which he asked if they had reviewed the surveillance footage.\n\nWithout warning or provocation, the officers forcibly handcuffed the plaintiff. While escorting him to their police vehicle, one officer punched the plaintiff between his neck and shoulder and kneed him in the rib cage. At the 81st precinct, the plaintiff experienced breathing difficulties due to his injuries and was taken to Interfaith Medical Center, where he was diagnosed with contused ribs and a right shoulder tear. He remained in the hospital overnight, handcuffed to the bed, and was prohibited by the officers from informing medical personnel about the cause of his injuries.\n\nThe next morning, defendant officer John Doe #2 returned the plaintiff to the 81st precinct and placed him in a dark room. There, he was interrogated by defendant officers Lim Taejin and Lt. Wilson, to which he did not respond. Officers included Officers Benigno Gonzalez, Brett Healy, James Wilson, and Thomas Jurewicz. They were looking for a badge that an officer had lost earlier that afternoon in the arrest of an unrelated party. Officers pushed Plaintiff Beauford when they entered and dragged Plaintiff Simmons into the hallway. They told Plaintiff Lawyer that an officer lost the badge and demanded he return it. Plaintiff Lawyer told Officers that he didn't have it but was searched anyway. When they left, Plaintiff Lawyer called an ambulance for Plaintiff Simmons who had been injured due to the officers' use of excessive force, and was treated at a medical center. Later, the officers returned to the residence and arrested Plaintiff Simmons and Plaintiff Beauford without cause, transported them to the police station,  and then transported them to central booking. [At a time not specified by the complaint,] Plaintiff Beauford was led out the \"back door\" while Plaintiff Simmons was released at arraignment.\n\nOfficers told Plaintiff Lawyer that if he turned himself in, they would release Simmons and Beauford. His name and picture were broadcast extensively on TV and in newspapers as a suspect in the badge theft. On June 24, 2013, Plaintiff Lawyer turned himself although he did not commit any crimes.
