An officer approached Quiles, told him his rear tail light was blinking, and asked for his driver’s license and registration. Quiles produced his driver’s license and registration, and the officer opened the rear passenger door of the vehicle and removed a bottle from the pocket of the passenger seat and asked what it was. Quiles responded that it was his daughter’s drink, “Malta.” The officer asked if he had been drinking and Quiles said he had not. The officers then returned to their patrol car and returned shortly thereafter, gave Quiles back his license and registration, and let him drive away. Less than five minutes later, Plaintiffs Quiles and Rodriguez were stopped again and Officer Flores asked Quiles for his license and registration. Quiles asked why but ultimately complied and asked if he was pulled over because of his tail light. Officer Flores said yes. She then asked Quiles if he had been arrested before, the nature of the offense, and when. Quiles explained he had been arrested before and answered Flores’s questions about the nature of the offense. \n\nFlores then asked Quiles if he had any drugs in the car, to which he responded no. She asked him to step out of the vehicle and Quiles complied. She searched Quiles, then handcuffed him and brought him to the back of the car. Rodriguez, who was sitting in the passenger seat, was ordered out of the car and searched. He informed the officers that he was diabetic and had insulin needles on him and that his cousin was taking him to the hospital. Officer Flores said “no its not” to Rodriguez’s assertion that the needles on him were for insulin. Officers handcuffed Rodriguez and searched the vehicle. Other officers arrived shortly after and drove away with Quiles’s  vehicle. The Plaintiffs were brought to the 40th precinct. Officer Flores informed Quiles he was being arrested because his cousin “had a needle and a beer” in his car and told both Plaintiffs that they were pulled over because of the broken front light. The Plaintiffs were physically searched and then transported to Central Booking.
