The Plaintiff proceeded up the stairs to purchase a metro-card. He was approached by Rinvil, Estevez and Appel. Rinvil asked Plaintiff for ID. Plaintiff complied. Defendants accused plaintiff of smoking a cigarette. Rinvil ordered Plaintiff to turn around and place his hands behind his back. Plaintiff began to comply when Estevez sprayed mace into the Plaintiff's face. Plaintiff was thrown on the ground, then down a flight of stairs. Plaintiff flagged down a marked police vehicle. Two officers exited the vehicle and pointed their weapons at the Plaintiff, ordering him on the ground. An officer took a baton and struck a plaintiff on the right side of his head. Plaintiff was struck four more times on his body with the baton. Plaintiff was handcuffed and put in a police vehicle. Plaintiff was transported to a police station inside the subway station. Plaintiff required medical attention, but EMS arrived 30 minutes later and had to wait for officers arrival before they could treat. Plaintiff was transported to Brookdale Hospital where his injuries were treated overnight. The next day, plaintiff was transported back to the precinct. Plaintiff was transported to Central Booking for arraignment. Bail was set at $5,000, which Plaintiff could not post. Plaintiff was in custody until the criminal case was dismissed by a Grand Jury on November 5, 2010. Plaintiff was not released from custody until November 6, 2010.\nOn March 7, 2013 at E. 146th Street in the Bronx, defendant officers arrived at Plaintiff's girlfriend's apartment. Plaintiff opened the door, and Kruk and Rendo dragged Plaintiff out of the residence, slammed him against a wall and handcuffed the Plaintiff. Plaintiff was transported to the precinct where Kruk, Rendo and Paulson grabbed plaintiff by the shirt, pulled him out of a holding cell, and slammed the Plaintiff into a metal gate, face first, breaking two of the Plaintiff's front teeth and fracturing his nose, requiring treatment at a local area hospital.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.348084/gov.uscourts.nyed.348084.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13138427/smith-v-city-of-new-york/"}],"id":"BT5D","url":"https://www.50-a.org/officer/BT5D"}
