Plaintiff repeatedly requested the defendant officers to loosen the handcuffs as the tightness was causing him substantial pain but was ignored. Plaintiff is a 20 year-old African-American male. The defendant officers fabricated a narrative that the Plaintiff used the end door of a subway car to pass from one subway car to another when there was no emergency, but the defendant officers have a pattern and practice of falsely accusing individuals of such actions where the defendant officers have used excessive and unreasonable force. The defendant officers desired to use Plaintiff's arrest and criminal prosecution to incur additional overtime compensation, benefits, and to avoid adverse consequences associated with failing to meet NYPD arrest quotas, particularly arrests of Hispanic or African-American men--a documented practice within the NYPD. The Plaintiff was arrested and taken to the 32nd precinct and eventually transported to Kings County Central booking. At Plaintiff's arraignment, his case was adjourned in contemplation of dismissal and was dismissed and sealed 6 months later.
