Plaintiff was taken to the precinct and then Central Booking, before going before a judge for arraignment. Plaintiff did not commit a crime and insisted he had no knowledge of the murder he was brought in for, but Detective Markardt claimed they had an eyewitness putting him at the scene of the crime. Detective Markardt had the eyewitness view a lineup that Plaintiff was placed in, but the eyewitness did not identify Plaintiff in said lineup. The officers then coerced the eyewitness to pick Plaintiff out of the lineup. On October 23, 2015, Plaintiff was convicted of Attempted Murder due to the illegal identification procedure used by the defendants, and sentenced to 22 years at Rikers, where he was subject to gang violence, solitary confinement and other physical and mental mistreatment; he also lost his job as a result of the false charges and has suffered significant financial and familial loss. On July 10, 2109, the Appellate Division overturned the trial verdict and remanded the case back to the trial court for a re-trial. On October 4, 2019, after unlawfully serving 5 years, 6 months and 3 days in jail, Plaintiff was released from Prison.
