POs Michael Alfano and Joseph Cuervo joined PO Benavides in arresting and handcuffing Plaintiff. Plaintiff was illegally searched but no contraband was found. Plaintiff asked PO Alfano why he was being arrested. In response PO Alfano forcefully slammed Plaintiff against a nearby subway station railing and told him \"Shut the fuck up, you know what you did.\" \n\nPlaintiff was driven around in a police van for a considerable period of time before he was taken to the 6th Precinct. Plaintiff remained at the precinct for approximately 12 hours, and was never informed of his Miranda rights though he was at least twice taken out for questions by various officers, including PO Alfano. POs initiated a malicious prosecution against Plaintiff, and Plaintiff was taken to Central Booking where he waited approximately 11 hours before seeing a judge. His false charges were initially adjourned in contemplation of dismissal but when lab tests failed to identify any controlled substances Plaintiff's case was dismissed outright in furtherance of justice.
