A male officer removed the blanket off of Plaintiff Miller and denied Plaintiff Miller's request to put on clothes and pulled down the blanket Miller used to cover herself.  About four or five officers observed Plaintiff Miller naked. Plaintiff Miller was placed in handcuffs, and Defendant Bridgett Penner/Jane Doe searched Plaintiff Miller, including penetrating Miller's vagina with the officer's fingers.  Defendants searched the apartment while Plaintiff were detained for about four hours. During the search, Defendants damaged and/or destroyed Plaintiffs' property. Defendants never presented a warrant nor stated exactly why they were searching the apartment or what they were looking for. Defendants did not find drugs, guns, or any other contraband in the apartment with the exception of marijuana in possession of a non-party to this matter. Plaintiff Andrea was taken from the hospital to the 73rd Precinct where she was kept in a holding cell with a woman who appeared mentally ill, compelling Plaintiff Andrea to stand on her feet the entire time she remained in the holding cell. Plaintiffs were then transported together to Central Booking, where they were held until their release through a rear door around 2:00 a.m. on May 4, 2013. The District Attorney's Office declined to prosecute due to insufficient evidence. When Plaintiffs returned home they found their residence completely torn apart, requiring several weeks to clean and fix the damage. Nevertheless, they were transported in handcuffs to the 73rd precinct. Inside the precinct, R.G. was searched by a female officer and handcuffed to a bar in a back room. Mr. Newsome was also searched and then placed in a cell with several other individuals. Approximately twelve hours later, Mr. Newsome was released with a Desk Appearance Ticket and R.G. was permitted to leave with him. When they returned to their home they had to gain entry by climbing through a window because Police officers had placed a padlock on the front door and claimed to have lost the key. Mr. Newsome was required to make a court appearance and wait several months before he was informed that the Kings County District Attorneys' Office declined to prosecute.
