The officers removed Ms. Jimenez and Mr. Julien from the apartment in handcuffs, put them in a police vehicle, and took them to the 120th Precinct. They were kept there until the following day. They were released following their arraignments in Richmond County Criminal Court on baseless charges. \n\nMs. Jimenez had to return to court for approximately eleven appearances. On August 6, 2012, all charges levied against Ms. Jimenez were dismissed and sealed. \n\nMr. Julien had to return to court for approximately seventeen appearances. Plaintiff urinated on herself. Defendants then grabbed and twisted Plaintiff's arms and placed excessively tight handcuffs on her wrist. Defendant Officers then rushed at Plaintiff's daughter with their firearms drawn, yanked her off her bed and onto the floor, and wrenched her arms behind her black placing excessively tight handcuffs on her wrist as well. While Plaintiff and her daughter lay in their nightclothes and underwear on the floor, Defendant Officers walked around the apartment and eventually allowed Plaintiff and her daughter to sit in their living room. Defendant Officers continuously ignored Plaintiff and her daughter's concerns, questions, and complaints about her injuries. After more complaints of wanting to be dressed, one female Defendant officer finally allowed them to take turns and get dressed. Defendant Officers did not have any reasonable basis to use any degree of force. Plaintiff received medical treatment at a hospital. Those Defendant Officers who did not touch Plaintiff witnessed these acts of force and failed to intervene (though this is not an official cause of action). The search of the apartment did not result in any finding of controlled substances, contraband, or weapons. Defendant Officers Hillery, Fago, Rivera, Fried, Brooks, Hernandez, Meigs, Sanches, and Sposito initiated and falsely and maliciously told the Richmond County DA's office that Plaintiff and her daughter committed various crimes by stating, among other things, that they were in possession of an amount of marijuana. RCDA declined to prosecute Plaintiff's daughter and she was released from Central Booking without any charges filed against her, while Plaintiff was arraigned. Defendant Officer Hillery and Fago obtained an unlawful search warrant by recklessly, deliberately, and inadequately conducting an investigation, and/or purposely misrepresenting facts to a court official. As a result of Plaintiff's arraignment and charges filed against her, she was wrongfully terminated from her place of employment.
