After the Plaintiff was discharged from the hospital, Plaintiff was taken to the precinct where he was arrested, processed, and fingerprinted. While plaintiff was in custody at the precinct, defendant, P.O. DINO DAVILA, prepared and filed false paperwork falsely accusing Plaintiff of Assault in the Third Degree, Criminal Possession of a Weapon in the Fourth Degree, and Harassment in the Second Degree. As a result, Plaintiff was arraigned on the evening of November 14, 2022, and charged with the aforementioned offenses. Plaintiff's brother's girlfriend had called the police in an attempt to evict plaintiff from his residence, his deceased grandmother's apartment, so plaintiff showed the police his ID, mail, and old rent checks when they arrived. Plaintiff became agitated after his brother's girlfriend insulted his deceased grandmother and hit his TV with a hammer as the responding officers stood in the hallway in front of the master bedroom in his apartment. Although plaintiff's hands were empty, both responding officers then pulled their weapons on the plaintiff, who informed them that he had nothing in his hands. His brother's girlfriend, however, told the officers he had a gun. The officers ordered plaintiff to exit the apartment with his hands up, which he did, and when he reached the door one of the responding officers kicked plaintiff in the back. Plaintiff jumped down the stairs and reached the building's lobby door. \n\nPlaintiff stopped still and dropped to his knees in response in response to an order from an officer, and both responding officers ran towards the plaintiff and kicked him in his side. Plaintiff was placed face down on the floor by one officer while the other officer handcuffed him. Defendant Galindo then placed his service weapon on the left side of plaintiff's temple while plaintiff was handcuffed, grinding the muzzle into the side of plaintiff's head, and threatened him. Defendant Galindo continued to strike the plaintiff for several minutes while Defendant Davilla radioed for backup. Plaintiff was then dragged upright in the elevator, and at that point realized his cousin had been recording the encounter in the hallway and lobby. Defendants Davilla and Galindo ceased assaulting plaintiff before backup arrived. When Defendant Sergeant Joseph Doria arrived on scene, plaintiff informed the superior officer about the conduct of the arresting officers, but defendant Doria laughed, and said only \"See, you live. Sue and get some money, you poor bastard.\" Defendant Doria took no other action. EMS took plaintiff to the hospital, where he was treated, his handcuffs were removed, and he was released without being charged.
