Plaintiff was an essential worker who had been making deliveries near a protest. Defendant officer John Doe 2 punched Plaintiff in the face. A group of Defender officers tackled and punched Plaintiff across his body including his ribs and striking Plaintiff’s back with batons. A Defendant officer tightly handcuffed Plaintiff. Plaintiff complained of the tightness of the handcuffs, which was ignored. Plaintiff’s hands had changed color due to the tightness of the handcuffs and he lost sensation in his right hand. As a result of being assaulted, battered and handcuffed, Plaintiff sustained a nasal fracture, an eye contusion, hyperextension of his shoulder, blurred vision and cuts and swelling to his wrists. Plaintiff was unlawfully arrested and transported to the 120th Precinct. P.O. Rodriguez initiated a malicious prosecution against Plaintiff, falsely alleging that he had witnessed Plaintiff failing to comply with then-existing curfew orders, despite not being present at the scene of arrest. On September 29, 2020, the criminal proceeding against Plaintiff was dismissed.
