After a suppression hearing on March 3, 2023, prosecution moved to dismiss Plaintiff’s indictment and the motion was granted. On March 4, 2021, Plaintiff was brutally assaulted by a person out on bail for second degree murder charges and lawfully defended himself. Detective Higgins coerced the assailant to press charges through threats regarding his pending charges, despite the fact that the assailant was an unreliable witness. On January 13, 2021, Plaintiff was falsely accused of burglarizing his own apartment that he was residing in as a lawful tenant.
