On said date but a few hours before said time Defendants allegedly observed a sale and transaction involving narcotics and falsely attributed said sale and transaction to Plaintiff, without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification as to the commission of unlawful conduct on the part of Plaintiff. On said date and time, Plaintiff was lawfully present in the vicinity of this complained-of- incident and had committed no crime nor engaged in any conduct whatsoever to suggest that Plaintiff was involved and/or related to the commission of a crime. Defendants then appeared in the vicinity of this complained-of-incident and illegally approached and falsely accused Plaintiff of a crime before illegally seizing his person with their outstretched hands violently and aggressively grabbing Plaintiff’s head and body, without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification whatsoever as to the commission of unlawful conduct on the part of Plaintiff. Defendants then illegally searched Plaintiff’s person by aggressively shoving their hands into his clothes and intimate areas. Defendants then grabbed Plaintiff about his body and extremities before violently contorting his arms and wrists behind his back and applying excessively tightened metal handcuffs, causing plaintiff to experience significant pain and discomfort. Plaintiff requested that the handcuffs be loosened, but said defendants ignored plaintiff’s pleas and conducted an illegal search of his person. Defendants then placed Plaintiff in a police vehicle and transported him against his will to the NYPD 40th Precinct where he was fingerprinted, photographed, strip-searched with attendant cavity inspection, questioned as to his pedigree, illegally interrogated without presence of counsel and being Mirandized, and illegally detained in a dank and dirty cell for a length of time before being transported to Central Booking, where Plaintiff was again processed pursuant to criminal incarceration and illegally detained throughout various dank and dirty cells over the course of a length of time until their release from physical custody of Defendants on or about December 2, 2022, after his arraignment. As a result, Plaintiff was deprived of his liberty over the course of approximately thirty (30) hours.  The criminal prosecution initiated by Defendants was terminated in Plaintiff’s favor when all adverse charges under Bronx County Criminal Court Docket No. CR-021776-22BX were unconditionally dismissed and sealed, pursuant to §§ 160.50 and 160.60 of the Criminal Procedure Law on or about March 1, 2023, likely due to a lack of probable cause to believe Plaintiff committed any criminal offense.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=DEOt_PLUS_KW3iQ9SuLzKwSqTwQ==","type":"complaint"}]},{"name":"Knight, Tahje vs City of Ny, et al.","start_date":"2023-06-29","payout_amount":0,"disposition":"","docket":"810019/2023E","court":"Supreme Court - Bronx","summary":"For years, NYPD officers of the 40th Precinct and Public Service Area unlawfully targeted Plaintiff and attempted to prosecute Plaintiff without probable cause. \n\nOn, March 12, 2021, plaintiff Tahje Knight was lawfully in the vicinity of East 125th Street in the Bronx when he was unlawfully approached, frisked, arrested and detained by defendant officers James Weck, Eric Dym, Michael Visintin, Jayther Liriano, Michael Kontorovich, Jose Tejada, and Nestor Amarantepolanco. When defendant officers stopped and frisked plaintiff and obtained no contraband, instead of releasing plaintiff, plaintiff was cuffed and detained to search for evidence of a crime.  \n\nPlaintiff was then falsely charged by defendant officer Weck of Disorderly Conduct, for running towards plaintiff in a violent manner when body camera footage shows that plaintiff stood completely still with his hands in the air as officers approached him. \n\nThe District Attorney's office declined to prosecute the bogus charge. \n\nOn June 5, 2021, defendant officers of the 40th Precinct including but not limited to defendant officers Hijazi and Juciano pulled over Plaintiff, asked him to step out of his vehicle, and arrested him. Defendant Sgt. Santos responded to the scene and did nothing to prevent the unlawful arrest or detention of Plaintiff. The officers did not look up Plaintiff’s driving record for at least two hours after the\narrest, at which time they used the information to charge Plaintiff with a traffic infraction without conducting any testing on the substance found in the vehicle to\nconfirm its contents, and maliciously charged Plaintiff without probable cause that the substance was, in fact, unlawful. Defendants held Plaintiff for over 24 hours before sending him to arraignment for the improper purpose of gathering evidence to cover up the unlawful stop.\nAll charges arising from this unlawful stop were dismissed in their entirety on the\nnearly two months later, on July 29, 2023. \n\nOn November 11, 2022, Does 1 and 2, both described as\nHispanic males, came to Plaintiff’s Bronx home, entered his bedroom while\nhe was asleep, shined their flashlights in his eyes, and claimed to have a warrant for his arrest. No such warrant ever existed.  At some point, Plaintiff learned that he was suspected of participating in a robbery. But after some time, Plaintiff was told that the case against him was “dismissed.” The Doe Defendants held Plaintiff for an additional 1–2 hours, again without probable cause, claiming that that there was a second warrant that needed to be “cleared” before Plaintiff could leave. Again, no such warrant ever existed. When the Doe Officers found nothing, they let Plaintiff go without any ticket, summons, or other paperwork, and Plaintiff never heard anything of the supposed warrants or potential charges again.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=_PLUS_Quw2bFJy4Pbh7AcAnhU7w==","type":"complaint"}]},{"name":"Djalo, Brahima vs City of New York, et al.","start_date":"2022-08-02","payout_amount":0,"disposition":"","docket":"810508/2022","court":"Supreme Court - Bronx","officer_name":"Hijazi, Zakaria O.","summary":"On November 30, 2021, at approximately 9:00 p.m., the Plaintiff, Brahima Djalo, was sitting in the passenger seat of his friend’s vehicle, which was parked in the vicinity of 149th Street and Tinton Street in the Bronx, New York, when several uniformed defendant officers approached the vehicle and told both\nmen to get out of the car. Mr. Djalo and his friend were confused as they were not parked illegally nor were there any equipment malfunctions with the vehicle, they had committed no crimes, nor had they engaged in any behavior that would prompt an interaction with police. The Defendant officers, including Officer Hijazi then reached through the passenger side window, unlocked the car, opened the door, and dragged the Mr. Djalo out of the vehicle. Officer Hijzai, along with three or four John Doe Police Officers, surrounded Mr. Djalo as he stood with his back against the passenger door of the vehicle and performed a pat search of Mr. Djalo without his consent or any lawful justification. The defendant Police Officers then unlawfully arrested Plaintiff without probable cause or legal justification.\n\nMr. Djalo was transported to the 40th Precinct, where he was processed and\nunlawfully placed in a holding cell. While Mr. Djalo was in custody, the defendant police officers provided the Bronx County District Attorney’s Office with the false, misleading and/or incomplete information that Plaintiff committed a crime. The following morning, at approximately 3 a.m. on December 1, 2021, the Mr. Djalo was released from custody at 40th Precinct with no charges; the Bronx County District Attorney had declined to prosecute, as the plaintiff had committed no crime. Some of the police officer defendants observed the violation of Mr. Djalo’s\nrights under the Constitution of the United States and New York State Law and did nothing to prevent their fellow officers from unjustifiably arresting, confining, and using excessive force against him.
