Plaintiff, who was fearful for his life, was able to get to his feet and flee from the officers before being tackled again and handcuffed. While Plaintiff was handcuffed, he was punched in the face and then searched. The Defendant officers claimed to have found a firearm at or near the vicinity in which Plaintiff had been located. However, no contraband or firearms were found on Plaintiff when he was searched. Plaintiff spent approximately 12 hours at the 43rd Precinct and PSA 8 before being taken to Bronx Central Booking where he awaited arraignment for another 12 hours. Defendant officers falsely submitted to the Bronx DA that at the time of his arrest, Plaintiff had been in possession of a firearm. Plaintiff was charged with Criminal Possession of a Weapon in the Second and Fourth Degrees as well as Possession of Pistol Ammunition.
