At the corner of the street, as Plaintiff Timotheus was walking to a bus stop, three Officers (John Doe 1 through 3) in an unmarked vehicle approached him and told Plaintiff Timotheus that he resembled someone they were looking for and showed a photograph of his nephew, Demetrius Altman. In fact, Demetrius was incarcerated at that time. Plaintiff Timotheus was placed in handcuffs. Informed by a neighbor that Timotheus was being arrested, Plaintiffs David and Edwin approached the scene and told Officers that they were Timotheus's nephew and brother and asked why he was being arrested. Officers John Doe 1 through 3 asked if they had come out of the Subject Premises. When Plaintiffs answered yes, they were also arrested. Then, numerous other vehicles pulled up in front of the Subject Premises and Officers ran in. Plaintiff Mack Altman was asleep in a bedroom on the 1st Floor; when Officers entered, Officers John Doe 4 through 5 woke him up, handcuffed him when he was completely nude, and, in the same state, took him into the living room of the Subject Premises. During the arrests, Officers had a search warrant that allowed them to search the 1st Floor and the person of Demetrius Altman; the warrant was issued after Officer JuanCarlos Cruz made false statements in an affidavit asserting reasonable cause to believe that illegal items would be found. At that time, Demetrius Altman was incarcerated and had not visited the Subject Premises for at least one year. After entry, Officers searched each apartment on each floor (basement, first floor apartment, and second floor apartment) of the Subject Premises. Nothing illegal was found.\n\nPlaintiffs were taken to the 81st police precinct where Plaintiffs David, Edwin, and Mack were strip searched by Officers John Does 6 through 8. Nothing illegal was recovered. They were released without charge. When Plaintiff David returned to the Subject Premises, he discovered that his $800 had been taken. The monies were neither vouchered by Officers nor have been returned to him.
